　　行凶者和雇凶者被判刑后，留给王建玲的伤痛才刚刚开始。

　　王建玲没有亲眼目睹丈夫被伤害的情景，但旁人的描述，却常常在她眼前出现。

　　2009年2月14日下午5时40分左右，江苏省徐州市沛县敬安镇闹市区一个巷口发生了令人胆战心惊的一幕：一名推着自行车的中年男子走近巷口，突然出现3名男子对他拳打脚踢，持刀对他猛刺、猛砍。

　　经讯问，民警大吃一惊：3人竟不认识李军，更无过节。

　　真相匪夷所思―――竟然是李军的“工作岗位”惹的祸。

　　吕伟交代，案发前几天，有人找到他，说愿出1万元叫他教训一下李军。拿到1000元“定金”后，吕伟又另外找了朱玉斌、杜新荣两人做帮手。

　　这显然是一起雇凶伤人案。“雇主是谁”？

　　吕伟交代，雇自己的人名叫郝敬全，他俩是在劳务市场认识的。可归案后的郝敬全却声称自己与李军也素不相识，真正的雇凶者名叫孙志国。

　　“孙志国不是新华信用分社的待岗员工吗，他为何要谋害同事呢？”民警立即拘传了孙志国。

　　原来，孙志国曾因个人不良责任贷款逾期没有收回，受到了留用察看处分。后来，母亲生病，孙志国就请了长假在家照顾。

　　2009年2月8日、11日，郝敬全两次指使人对封超实施殴打，致其眼部受到轻微伤。

　　因伤势不重，封超仍能坚持每天正常上班。

　　孙志国又迁怒于刚刚调任新华信用分社负责人的李军，认为是李军占了自己的岗位，于是再次出资1万元，唆使郝敬全雇人打伤李军，以便顶替李军的岗位。

　　他们没料到，因下手太重，竟然致李军死亡。

　　2010年3月，江苏省徐州市中级人民法院以故意伤害罪判处被告人孙志国死刑，其他4名被告人分别被判处死刑缓期两年执行、无期徒刑、有期徒刑15年。同时，法院还判决5名被告人赔偿被害人李军的亲属各项损失共36万余元。

　　然而，由于5名被告人都没可执行的财产，法院“财产刑”的判决成了一纸空文。

　　履职之争

　　值班途中遇害不算工伤

　　李军原是家中的顶梁柱，上有年迈的父母、下有未成年的儿子，妻子也失业在家。如今，他这顶梁柱一倒，家中就没了经济来源。

　　2009年7月6日，沛县劳动保障局作出了“不予认定工伤”的决定。

　　王建玲不服，向江苏省徐州市劳动和社会保障局申请行政复议。

　　2009年11月，徐州市劳动保障局出具行政复议决定书，维持沛县劳动保障局的认定。

　　2010年3月，王建玲向徐州市鼓楼区人民法院提起诉讼，将徐州市、沛县两级劳动部门告上法庭，请求撤销沛县劳动保障局作出的关于李军不予认定工伤的决定和徐州市劳动保障局行政复议维持决定书，并请求认定李军遇害属于工伤。

　　2010年4月2日，徐州市鼓楼区法院开庭审理此案。法庭上，原被告双方围绕李军是否属于履行工作职责而受到暴力伤害进行了激烈的辩论。

　　王建玲认为，李军与孙志国从未有过个人恩怨，他完全是因工作原因遇害的。孙志国雇凶拦截伤害李军的目的就是要使李军不能在工作岗位上继续工作，由他来顶替，这充分证明，李军受到的伤害与他的工作岗位及职责具有直接的因果关系。李军在值班途中因工作问题而遇害，应认定是在工作时间和工作场所。

　　而被告认为，工伤归根结底属于一种职业伤害，是劳动者在从事生产工作中，由于用人单位提供的生产设备或工作条件存在安全因素，导致发生事故伤害，劳动者的生命健康权被剥夺的情形，这是工伤事故与其他人身事故伤害的主要区别所在。李军的死亡是犯罪人员实施暴力犯罪所为，且暴力犯罪行为与李军所从事的储蓄工作无直接的因果关系，并非工作原因所致的死亡。值班途中也不是在工作时间和工作场所。

　　原被告双方针锋相对，谁也说服不了谁。

　　2010年5月20日，法院作出一审判决，驳回了王建玲的诉讼请求。

　　法院认为，被害人伤亡的直接原因在于加害人出于“顶岗”目的而实施雇凶伤害，“顶岗”的工作因素与被害人伤亡之间不具备因果关系。

　　被害人的工作职务是新华信用分社的负责人，其具体工作职责是“记账”及敬安信用社本部夜间安全保卫。下午5时40分，李军从新华信用分社下班后至敬安信用社本部值夜班的途中，并非在履行其工作职责中受到的伤害，且被害人与加害人之间无工作上的领导与被领导、管理与被管理关系，加害人的侵害对象是新华信用分社的所有在岗职工，其与受害人之间不存在由于受害人履行工作职责产生的个人恩怨，因此，“履行工作职责”与被害人伤亡之间不具备因果关系。

　　5月31日，王建玲提起上诉，目前正在等待二审结果。

　　南京大学劳动法学专家接受《法治周末》采访时说，我国工伤保险条例第十四条规定，工作时间、工作场所和工作原因是工伤认定的3大要素。

　　专家认为，李军被害既非情杀，也非财杀，更非个人恩怨引起的仇杀所致，完全是工作原因引起的―――被告人孙志国认为李军的正常工作挡了他上岗的道。

　　工作原因是不是就是履行工作呢？

　　中国人民大学法学院教授黎建飞认为，工作原因是从加害人的行为推导出来的，而工伤的工作原因就是工作职责，就是在履行工作职责中受到了伤害，这是工伤的一个最根本点。

　　专家说，综合本案案情来看，李军被害确因履行工作职责而引起，其符合工伤认定的核心要素―――工作原因。在符合工作原因的前提下，工作时间和工作场所要素应作为辅助性要素予以认定。

　　专家强调，劳动关系中，工伤保护的法律原则和精神是保障无恶意劳动者因工作或与工作相关活动中伤亡后能获得救济，只要劳动者受到的伤害与工作的内容相关联，对于工作时间的界定要根据不同工作性质来判断，只要伤害情形不属于工伤排除范围，就应当认定为工伤。

　　本案中，李军虽然在值班途中被害，但原因是基于履行工作职责。如果仅因几分钟时间没有赶到值班地点就不认定为工伤，如果认真履行职责却不认定是工作原因，结果得不到任何工伤赔偿，这与劳动法保护劳动者合法权益的立法本意和公平原则以及工伤保险条例的立法宗旨不符。
